By using the Elefant toy rental app, you agree to be bound by the following terms and conditions ("Terms").
1. Eligibility
To use our Service, you must be at least 18 years old and able to form legally binding contracts under applicable law.
2. Account Registration
You must provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
3. Payments
By renting a toy from our Service, you agree to pay the applicable rental fee and any additional charges that may apply, such as late fees or damage fees.
4. Rental Period and Returns
All rented toys must be returned within the agreed rental period. Failure to return the toys on time may result in additional late fees.
5. Prohibited Activities
You agree not to engage in any activity that interferes with or disrupts the Service or the servers and networks connected to the Service.
6. Termination
We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
7. Limitation of Liability
In no event shall Madshades Technologies Pvt. Ltd. be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
8. Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will provide a notice of the changes on our website or in the app. Your continued use of the Service after any changes to the Terms constitutes your acceptance of the new Terms.
Refer & Earn
The referral program ("Program") is open to all users signed up on The EleFant ("Referrers") and individuals who are referred to The EleFant through the Program ("Referees").
1. How it Works:
Referrers will receive Rs 200 credited to their wallet for each new customer who subscribes to the EleFant plans using their unique referral code.
Referees will receive Rs 1200 off, comprising a Rs 200 referral bonus and a Rs 1000 discount on the selected membership plan.
2. Referral Code:
Each referrer will be provided with a unique referral code to share with potential referees.
Referees must enter the referral code at the time of purchasing the EleFant membership to beeligible for the Program benefits.
3. Program Period:
The Program is effective starting 26th January, 2024 and will continue until terminated by the EleFant, at its discretion.
4. Payouts:
Referrer can request for encashment from the wallet by entering their bank details.
Referee discounts of Rs 1200 will be applied to the total amount payable during the membership sign-up process.
5. Restrictions:
Referrers cannot refer themselves or create multiple accounts to benefit from the Program.
Referees must be new customers and cannot have an existing membership with the EleFant.
6. Validity of Referral Codes:
Referral codes per user shall remain the same and can be used for multiple referrals.
7. Modification and Termination:
The EleFant reserves the right to modify, suspend, or terminate the Program at any time for any reason without prior notice.
8. Fraudulent Activity:
The EleFant reserves the right to investigate and disqualify any Referrer or Referee involved in fraudulent activity, including but not limited to creating fake accounts or engaging in deceptive practices.
9. Governing Law:
These terms and conditions are governed by the laws of [Your Jurisdiction]. Any disputes arising out of or in connection with the Program shall be resolved through arbitration in accordance with the rules of [Arbitration Institution].
